Basic Divorce

A basic divorce is simply a dissolution of the marriage. There is no provision for custody, child support, spousal maintenance, or equitable distribution.

Divorce with Children, no Stipulation

A divorce with children must address custody and child support. One option is to resolve these two issues in Family Court. Another option is to have these part of the divorce itself. For child support, additional worksheets must be filled out, unless there is a stipulation of settlement.

Divorce with a Written Stipulation or Agreement

When spousal support or if there is marital property which needs to be divided, a separate written agreement is usually necessary. A good rule of thumb is if there are any obligations which exist past the divorce, a stipulation is the best option.
